Eugene Dariush Daneshvar, JD PhD
Dr. Eugene Dariush Daneshvar advises clients on intellectual property matters including patent portfolio development connected to asset acquisitions, patent licenses, and venture financings. Eugene previously represented companies in intellectual property litigation in the Patent Trial and Appeal Board (PTAB) and district courts. He counsels companies throughout the lifecycle of a patent including patentability, non-infringement, freedom to operate, and post-grant review.

Litigation Experience
Select Matters 10X Genomics, Inc. v. Bio-Rad Laboratories Drafted expert reports for a set of inter partes review petitions on behalf of biotechnology company 10X Genomics, Inc. against five patents asserted by Bio-Rad in parallel ITC and district court cases. Our team also filed three reexamination requests against patents asserted by Bio-Rad. Resulted in a victory for 10X Genomics, all reexamination requests were granted as to every ground and every claim. St. Croix Surgical Systems v. Cardinal Health, Inc. Drafted the complaint. Refined and sharpened a portfolio of patents directed to novel medical devices. Resulted in one case settling in the midst of Markman briefing, the other settled following a Markman order that turned in St. Croix’s favor on every disputed construction. Fulfillium, Inc. v. ReShape Medical, Inc. et al. Refined and sharpened a portfolio of patents directed to novel medical devices. Part of a team that successfully enforced the new patents and related trade secrets in the United States District Court for the Central District of California. The last defendant settled day before trial resulting in a seven figure settlement that equated to a 60 percent royalty on sales of the accused product. Exactech v. Zimmer Biomet (S.D. Cal., M.D. Fla., PTAB) Represented Exactech in trade secret, copyright, and patent litigation relating to allegations that a Zimmer patent relating to a medical device incorporated Exactech’s trade secrets. Resulted in settlement and assignment of the patent at issue to Exactech. Canon, Inc. v. TCL Electronics Holdings Ltd. (E.D. Tex.; N.D. Cal.) Compiled technical reports on infringement and patent validity in a multi-patent infringement lawsuit filed by Canon concerning video streaming and smart TV functionality and interfaces. Resulted in a very favorable settlement that included a license for all of Roku’s TV partners. A Global Leader in Medical Technology, Services, and Solutions (PTAB, CAFC) Represented the company in multiple IPRs relating to trans-catheter replacement heart valves.
